1. Who we are

BlueBaħar (the "app") is operated by Impossible Labs ("we", "us"). By installing or using the app you agree to these Terms of Service. If you do not agree, please do not use the app.

2. What the app does

BlueBaħar is a maritime information viewer and reporting tool that displays publicly available information about Maltese waters — including notices to mariners, hazards, restricted and protected zones, and weather forecasts — on an interactive map.

Most maritime information is sourced from open data published by the Government of Malta and its agencies and is fetched through our backend. Weather forecasts are fetched directly from Open-Meteo, and the map background is provided by Mapbox. We do not author or independently verify the underlying third-party content.

3. No warranty on information

We make reasonable efforts to keep the information up to date, but we provide it on an "as is" and "as available" basis, without warranties of any kind. We do not guarantee that the data is accurate, complete, current, or fit for any particular purpose. Source datasets may be delayed, withdrawn, or contain errors that propagate to the app.

For authoritative information, always consult the latest official notices and publications issued by the Maltese maritime authorities and use approved navigational equipment.

4. Acceptable use

You agree not to:

• use the app or its backend in any way that violates applicable law;
• attempt to disrupt, overload, probe, or reverse-engineer our service;
• scrape or rebroadcast the data through the app in a way that misrepresents its source or freshness;
• use the app in a manner that endangers people, vessels, property, or the marine environment.

5. Access and app-store terms

BlueBaħar is currently offered without a subscription or in-app purchase. You can use the map, notices, datasets, weather views, reports, and optional notifications without creating an account.

Downloads, updates, ratings, and any store-level account interactions are handled by the Apple App Store or Google Play under their own terms. If we introduce paid features in the future, we will update these terms before those features are made available.

6. Intellectual property

The app's name, logo, design, and software are owned by Impossible Labs. The underlying maritime data remains the property of its respective publishers and is made available under the terms set out by those publishers.

7. Privacy

Use of the app is also governed by our Privacy Policy. The app does not require an account or ask for your name or email address. Exact device coordinates normally stay on your device. The app sends an approximately 1-kilometre area directly to Open-Meteo for location-based weather; if you enable "Share boat traffic", it also contributes an anonymous approximate marine area as explained in the Privacy Policy. We collect only limited operational data to run and improve the service, including anonymous analytics, crash reports, optional push-notification tokens, and report content you choose to send.

8. Limitation of liability

To the maximum extent permitted by law, Impossible Labs and its contributors shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages arising out of or in connection with your use of, or inability to use, the app — including any decisions taken on the basis of information shown in the app.

9. Service availability

The app and the backend may be modified, suspended, or discontinued at any time, with or without notice. App updates are delivered through the Apple App Store or Google Play and may be installed automatically if you have enabled automatic store updates on your device. BlueBaħar does not deliver Expo over-the-air updates.

10. Changes to these terms

We may update these terms occasionally. Continued use of the app after changes take effect constitutes acceptance of the updated terms. The "last updated" date above reflects the current version.

11. Governing law

These terms are governed by the laws of Malta. Any dispute arising from the use of the app shall be subject to the non-exclusive jurisdiction of the courts of Malta.
